BENGALURU: The high court on Friday permitted the state government to consider and pass appropriate orders on applications received by the deputy commissioner, Bengaluru Urban, with regard to the use of Idgah Maidan, Chamarajpet for holding religious and cultural activities for a limited period from August 31.
A division bench headed by acting Chief Justice Alok Aradhe and Justice S Vishwajith Shetty issued the direction, while modifying the single-judge bench order of August 25 to maintain status quo.
The single judge, on a petition filed by Karnataka State Board of Auqaf, had said the parties are restrained from using the subject land for any purpose other than for celebrating Independence Day and Republic Day, as a public playground, and for prayers of the Muslim community on the days of Ramzan and Bakrid festivals.
“The controversy is pending adjudication before the learned single judge. The Indian society comprises religious, linguistic, regional or sectional diversities. The Constitution of India itself fosters brotherhood among various sections of society. The principle of religious toleration is the characteristic of Indian civilization. We therefore, at this stage, in the peculiar facts of the case, modify the interim order dated 25.08.2022 and permit the state government to consider and pass appropriate orders on applications received by the deputy commissioner seeking use of the land in question for holding religious and cultural activities for a limited period August 31 onwards,” the division bench observed.
The division bench clarified that “the rest of the directions contained in the order passed by the learned single judge remain unaltered”.
The Auqaf board had questioned the BBMP joint commissioner’s order of rejecting its plea for grant of khata in favour of the board in respect of Idgah Maidan.
