MUMBAI: The NGT on March 15 admitted an application filed by an NGO Vanashakti which alleged that waste was being dumped on the bank of Mumbra creek and demanded that the Thane Municipal Corporation (TMC) be directed to act to ensure restoration of mangroves and fines on offenders.
An abnormally large quantity of mixed waste of 650 MT/day was being dumped by respondent TMC, the state pollution control authority had said in 2019 in a notice to TMC.
The application sought orders from NGT to TMC to close what it said was an “ unscientific Diva dumping ground operated by it”. The ground is at Diva-Khardi Road, Thane, on the bank of Mumbra creek inside CRZ-1 area, in violation of green laws governing coastal zones. The site is unauthorised, said the NGO.
The NGT bench comprising Justice DK Singh and expert-member Dr Vijay Kulkarni said in its order, “prima facie we find that the question of adverse impact on environment has been raised in this application. Hence, the application deserves to be admitted,’’ and issued notice to the Thane Municipal Corporation and set it for hearing on May 8.
A joint visit to the site was undertaken by the team of auditor general with TMC in 2017. It was noticed during the inspection that “waste was being dumped on the bank of Mumbra creek violating the norms of Coastal Regulation Zone Rules. No provision for leachate collection and treatment facility was made at the dumping site which could badly affect the environment of the coastal zone.”
Vanshakti said in 2019, various fire incidents had occurred, after which Maharastra pollution control board (MPCB) issued show-cause notice to TMC on
28.05.2019. It followed up with another notice seven months later under the Environment Protection Act, observing dumping of 750 MTD of solid waste sans treatment.
In January 2020 MOCB imposed a fine of Rs 12 lakh for non-submission of solid waste information on the web portal of MPCB.
The NGO said it also tested a sample of water and found its levels were off for various parameters.
